Retirement Living Regulation in Quebec

Quebec is one of only 4 provinces in Canada with some form of legislation to protect seniors in retirement level homes. “Residences for the Elderly” must be registered with the “Registry of Residences for the Elderly” (Registre des residences pour personnes agees) and hold “a certificate of compliance” issued by the “Agence de la sante et des services sociaux de l’Outaouais” (Health and Social Services Agency). The issuance of a Certificate of Compliance is based on sections of Bill 83 (in 2005) during which reforms were made to the Health and Social Services Act; homes were given until 2009 to comply. As of February 2009 all existing residences must obtain a certificate of compliance. Quebec enforces a mandatory recertification process every two years.

The Regulations include:

  • General factors – i.e. respect, adequate space, access to activities
  • Exchange of information – required documentation to be given to resident
  • Health & Safety of residents
  • Food & medication
  • Liability Insurance

New homes do not require a permit to open however they must register the home and get a Certificate of Compliance. There are set regulations based on 25 different criteria that must be met in order to be granted a certificate and, a not-for-profit independent agency does the inspections. Homes with personal assistance services must comply with all criteria.
